Extra Work
 

Any extra work i.e; Special Amenities for modern comfort & Gracious living other than standard amenities / specification for standard living shall be charged extra as decided by our engineer and as per our price list / chart and such amount shall have to be deposited before the execution of work.

   
Maintenance (Regular)
 

Common services of apartment, until handed over to other agencies / society for maintenance shall be maintained by the developer / builder which will be payable by the purchaser on 1st day of every month as fixed for various flats & its owners developer. The sum of Rs.10/- per Sqr.ft of that area shall be deposited by the purchaser as interest free security with the developer on this account, for default adjustment. When the security deposit will be exhausted after adjusting the default monthly maintenance charges then the developer / management will have power and  authority to cut power & water connection to the respective flats (in default).

   
Maintenance (Major & Annual)
 

Major maintenance which may arise time to time like sewerage clearance and disposal, electrical maintenance of substation, outside painting of building / compound wall / gate etc to be carried out after forming a consensus among house owners & dividing the cost ratio wise among the owners.

   
Parking
 

Two wheeler parking space will be provided free of cost. Under roof parking space can be reserved on payment of extra charges. Those unit holder will reserve the car parking space in payment will have to park their own 2 wheeler in that reserved space. Society / Developer / Builder will decide regarding all parking formalities other than whatever unit reserved.

   
Taxes
  As applicable as per norms.
   
Electric Meter
 

Electric meter with transformer & main control & cable formalities & cabling work till flat meter will be charged extra.

   

Municipality Holding Tax (if any)

 

Municipality Holding Tax (if any) will be charged extra and can be arranged by builder / Developer at extra cost.

   
Society
 

The process of society formation will start only after all members i.e; unit holders / flat owners deposit the security deposit as well as the formation of society charges. Society formation will be done after handover & registration of units / flats and the total cost of formation etc will be charged extra. Members will also have liberty to form the society at their own risk and cost. The builder or promoter doesn’t hold guarantee or will be liable to form the society, hence it is the sole responsibility of the owner or unit holder / purchaser to form the society / management body of the complex and all necessary help will be rendered by builder.

   
Registration
 

The cost of registration charges, solicitors / advocates fees, other duties and charges as  applicable by statutory authority on the date of registration shall be on account of the purchaser. Registration will be done on the list price of the flat purchased by the owner plus all extra work bill. Registration / Execution of Sale Deed will only be done after clearance of all dues by the customer on account of flat price & extra bill

   
Time of Completion
 

The flats / units are expected to be completed by 24 months- 30 months after execution of allotment / agreement & payment of 1st installment and depending upon the type of payment made by customer as per the payment condition

   

Possession

 

Possession of the flat shall be given to the purchaser only after all due amount have been deposited. The actual date of physical possession will be considered from the date of possession letter issued by the builder / Developer & not the date of possession letter received & accepted by the house owner.

   
Surrender / Cancellation
 

In case of surrender / cancellation the amount of deposit shall be refunded without any interest only after adjusting / deducting 20% of the total amount paid to the developer / builder or 10% of the flat cost amount whichever higher. Anyhow the minimum deduction amount whatever may be the payment will be minimum Rs.20,000/- (Rupees Twenty Thousand Only). Further also the refund amount after cancellation will be returned only after receiving full payment against the same flat booked by new / fresh applicant / customer.

   
Penal Interest
 

If the amount payable as per payment schedule is not paid within the prescribed / schedule time, then penal interest @24% Per Annum shall be payable by purchaser on the amount due.

   
Minor Changes in the design
 

The design of flats and their areas are liable to changes on finalization of drawing during construction for which no objection will be entertained. Accordingly any changes in SBA of units / flats will be charged and payment to be made. Hence Kalpana Construction has all rights to change the design as may be required, but once after completion of work any changes made by the flat / unit owners, the same has to be done in consultation & consent from the society / Management of complex & developer & its Architect & Engineer. In that case house owner will be liable for any structural changes & design changes & extra work taken up by the unit / house owner.

   
Power Load to Flats
 
  • All power points in electrical to be provided exclusively on extra payment and the builder / developer / Kalpana Constructions will not be responsible for any fluctuation in total load factor of the unit / flat other than fixed and standard load provided by builder . The proposed minimum power load to 1BR = 1KW, 2BR = 2KW, 3BR = 3KW. The builder will responsible as per the above load sanctioned by CESU & load connected as above to the flats and not as per the points provided (as per consent of house owner).

 
  • The project is expected to be completed within 30 months. Force major clause applicable for any unforeseen incidents on which developer / builder does not have any control, hence project may get delayed. The customer ceases right to ask for timely completion of the project due to his / her default of payment / regular installments in time

 
  • Possession will be given on clearance of full dues by the customer, whatever may the case may be.

 
  • Kalpana Construction reserves the right to cancel the allotment in case of default payment or on other reasonable grounds and without ascertaining any reasons also

 
  • Any disputes arising has to be settled within Bhubaneswar Jurisdiction only.

 
  • The actual date of completion will be accounted for only from the date of flat / unit allotment & 1st installment  not on the date of booking / payment of commitment fees / amount or finalization of booking

 
  • The customer will take / bear all responsibility to get the finance approved and bank finance from any financial institution, and any default or delay in payment by the same bank will not be the responsibility of the builder. The builder may only assist to get the home loan financed by the bank but will not hold responsible
